ELECTRONIC DELIVERY OF POLICY DOCUMENTS TERMS AND CONDITIONS
If you wish to receive a paperless Policy which will be sent via Electronic Delivery, instead of by Mail Delivery, you must agree to the following Paperless Policy Terms and Conditions (“Paperless Terms and Conditions”).
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY CLICKING “I AGREE” YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS BELOW. THESE PAPERLESS TERMS AND CONDITIONS ARE SUBJECT TO CHANGE, FROM TIME TO TIME, IN OUR SOLE DISCRETION. WE RECOMMEND YOU REVIEW THEM PERIODICALLY FOR ANY CHANGES. IF YOU DO NOT AGREE WITH THESE PAPERLESS TERMS AND CONDITIONS, PLEASE DO NOT CLICK “I AGREE”.
You represent that you have the authority to act on behalf of the Account and, should you consent to receive Policy Documents electronically, you understand and agree that you do so on behalf of the Account. If you wish to receive a Policy by Electronic Delivery on behalf of one or more designated Named Insureds but not on behalf of the Account, do NOT select “I AGREE” at the bottom of these Paperless Terms and Conditions. Instead, you should contact your agent or broker. For purposes of these Paperless Terms and Conditions, the following definitions apply:
“Account” means Named Insured, as well as any affiliated Named Insureds whose Policy is viewable using active login credentials for My Business Online or listed as Named Insureds on the Polic(ies).
“Mail Delivery” means delivery via regular mail to the address shown in the Declarations page of the Policy.
“Paperless Delivery” means either, at our discretion, (i) delivery of your Policy via e-mail or as an attachment to an e-mail; or (2) delivery via an e-mail with a link to the specified document on a particular website (i.e. My Business Online) with the use of a username and password.
“Policy” or “Policies” means the insurance policy or policies issued to the Account, including, but not limited to policy jackets, endorsements and declarations pages, important notices, automobile id cards, change declarations, consumer bills of rights, newsletters, information about your policy, certain underwriting documentation, applications, questionnaires, surveys, and any other documents related to the Policy or Policies.
Your consent to Paperless Delivery will remain in effect and will apply to all future renewals, continuations, replacements and changes to any Policy(ies) unless:
You withdraw your consent in accordance with these Paperless Terms and Conditions; or
We terminate, for any reason, the ability for you to receive Policy Documents electronically.
We are not liable for any loss, liability, cost, expense or claim arising out of these Paperless Terms and Conditions or your election to receive your Policy by Electronic Delivery.
Email Address of Record
At the time you elect to receive a Policy by Paperless Delivery, you will need to designate an email address ("Email Address of Record") to use for Paperless Delivery. An Email Address of Record must be the email address of a Named Insured who has authority to act on behalf of the Account.
You can change or update an Email Address of Record by logging into My Business Online and updating it under the Manage Preferences option. We will not be liable for any loss, liability, cost, expense or claim arising out of an incorrect Email Address of Record.
How to Withdraw Consent
You may withdraw your consent to receive Paperless Delivery of your Policy by logging into My Business Online and updating your preferences by selecting ‘Manage Paperless Delivery’ on the Policy Documents tab, or by contacting Liberty Mutual Insurance. At our option, we may treat your provision of an invalid Email Address of Record or the subsequent malfunction of a previously valid Email Address of Record, as a withdrawal of your consent to receive to receive your Policy by Paperless Delivery. We will not impose any fee to process the withdrawal of your consent. A withdrawal of your consent will be effective only after we have had a reasonable period of time to process your request.
Time for Enrollment, Changes or Withdrawal of Consent to Become Effective
It may take a period of time for us to process your enrollment for a paperless Policy, process a change to an Email Address of Record or process any request to withdraw consent to receive your Policy by Paperless Delivery. We will send your Policy to you by Mail Delivery until we process your consent. Changes to any Email Address of Record or withdrawal of your consent to receive a paperless Policy are not effective until we process the change. We will continue to send your Policy to the Email Address of Record until any change becomes effective.
Hardware and Software Requirements
In order to access, view and retain your Policy that we make available to you, you must: have a device that will connect to the Internet, access to an e-mail account and access to an internet browser. We will update you if there are any changes to the hardware or software requirements that could impact your receiving a paperless Policy.
By providing consent to receive your Policy by Paperless Delivery, you acknowledge that you have the minimum hardware and software requirements listed in this section.
Modification and Termination by Us
We reserve the right, in our sole discretion, to discontinue Paperless Delivery, or to terminate or change these Paperless Terms and Conditions at any time. We will provide you with notice of any such termination or change if required by law.
Communications in Writing
All communications in either electronic or paper format from us to you will be considered "in writing." You should print or download for your records a copy of your Policy and these Paperless Terms and Conditions.
Paper Documents
You may request a paper copy of your Policy Documents at any time at no additional charge by contacting Liberty Mutual Insurance.
Governing Law
You acknowledge and agree that your consent to transact electronic business is being provided in connection with a transaction affecting interstate commerce that is subject to the federal Electronic Signatures in Global and National Commerce Act, and your state's Uniform Electronic Transactions Act law as applicable.
By selecting “Accept,” you elect to receive your Policy by Paperless Delivery and agree to these Paperless Terms and Conditions.
